Am I entitled to compensation under the Criminal Injuries Compensation Authority (CICA)

The Criminal Injuries Compensation Act 1995 (CICA) made provision for the payment of compensation to, or in respect of, persons who have sustained criminal injuries under the Criminal Injuries Compensation Scheme (2008).

If you have sustained a criminal injury on or after 1st August 1964, or where the victim of a criminal injury sustained on or after 1st August 1964 has since died, there may be a claim for compensation.

Criminal injuries are defined as injuries sustained in and directly attributable to an act occuring in Great Britain, which is:

  • A crime of violence, including arson, fire-raising or poisoning
  • An offence of trespass on a railway
  • The apprehension or attempted apprehension of an offender or a suspected offender
  • The prevention or attempted prevention of a an offence
  • The giving of help to any Constable who is engaged in any such activity

Personal injury is defined as:

  • Physical injury (including fatal injury)
  • Mental injury
  • Disease

Compensation will not be paid for mental injury or disease without physical injury

In some circumstances sexual offences are also exluded from the Act
