Lawyer warns: “Don’t swap your legal rights for money.”
Road accident victims could be missing out on thousands of pounds in compensation because insurance companies are forcing them to accept low settlements and telling them they don’t need legal representation.
That’s the warning from Neil Hudgell Law, solicitors with offices in Hull and Leeds. It comes after the firm dealt with the case of a road accident victim who was originally offered only £3,000 compensation but is now set to get a pay-out of more than £19,000.
Neil Hudgell, the managing director, says cases like this, where victims consult his firm after being forced to sign documents waiving their legal rights, are not unusual.
Neil Hudgell said: “I would urge anyone involved in any kind of accident not to swap their legal rights for money. Don’t accept any financial offer until you’ve consulted a solicitor. Insurers should not be settling claims directly with clients, offering low levels of compensation and telling them that they don’t need lawyers.
“Accident victims are being fobbed-off with derisory compensation, far less than they should be offered. The risk is that people who’ve suffered terrible injuries could miss out on money to which they’re genuinely entitled.”
In the recent case where the victim was originally offered only £3,000 but is now set to get a pay-out of more than £19,000, the insurance company had forced her into signing a disclaimer waiving her legal rights even though the woman was originally from Latvia and had very little English.
The 32 year old factory worker suffered serious injuries to her right arm when the car in which she was a passenger crashed on the way to work in Malton in November 2009. The woman, who was pregnant at the time, had to undergo two operations to her arm and a course of treatment lasting several months. It was only after hearing an advert on the radio that the victim realised she may be entitled to a larger amount of compensation than originally offered.
The woman, who wishes to remain anonymous, said: “The accident turned my world upside down, I was in pain and shock and couldn’t work. At first, the insurance company put me under a lot of pressure to accept their offer of £3,000 and said that I didn’t need a lawyer. Now I’m very glad I ignored them. To anyone in the same position I’d tell them not to sign away their legal rights.”
Neil Hudgell said: “We were very pleased to be able to get the disclaimer she’d been forced to signed declared void and to secure fair and increased compensation for this lady. The money will help cover the costs of the extra care she’s needed and the earnings she’s lost as a result of the accident.”
