A court has ruled that a teenager from Bridlington should be awarded more than £6,000 compensation for being wrongfully arrested by police when he was aged 14.
At Hull County Court (May 10, 2011), Mr Recorder Attwooll found in favour of David Robson, the Claimant, concerning his wrongful arrest by Humberside Police.
David had attended with his father, Tony Robson, an appointment at Bridlington Police station on November 26, 2007. The purpose of the appointment was for the police to investigate complaints made by Mr Robson against another local man and the man’s threats to kill.
However, the interview became heated and a dispute arose between the interviewing officer and Tony Robson over his fire arms licence. The officer decided to arrest Mr Robson and this then also lead to the arrest of 14 year old David.
Recorder Attwooll found:
“I conclude that the arrest was disproportionate and a disproportionate response to the situation as a whole as no other avenues were explored.
“I find there were no reasonable grounds for believing arrest was necessary and PACE Code G 2 (1) and (2) it was disproportionate, in the sense that it was premature.”
Tony Robson said: “It was a good victory and it proved a point. I am over the moon with Neil Hudgell Law. How they conducted the case and their service was spot on.”
An award of £2,050 was made for the arrest and very minor assault (grabbing David’s arm) and an award of aggravated damages was then made, in the value of double the award, to reflect the particular circumstances of the case.
It was the Judge’s findings that this was traumatic for a young child, in the company of his arrested father and had an effect upon him. Therefore, a final award was made of £6,150.00
David Robson is now 17. His case was taken up by Neil Hudgell Law in January 2011 after his former solicitors withdrew their services leaving the family without representation or support.

As you can imagine, David is delighted his name has been cleared entirely, which was his main concern as an intelligent young man hopefully bound for University.”
